The loser of a legal suit always pays the legal fees....


However if there is a defect in the equipment that was used that resulted in the death of a person then I don't see how the hell the company won the suit.

She was not wearing a helmet and Yamaha maintained people were recklessly driving the Rhino.
Nvm, stupid parent's = child\driver nominated for a Darwin Award imo.

We've followed this lawsuit since day 1 Alex....it was pretty straight forward from the outside looking in that Yamaha was not in the wrong, but ya never know what loop-hole Sand's attorneys would chase after.......and apparently not all suits are set up for loser to pay all legal costs on both sides, as I thought also......Lance

Generally speaking, in federal court the loser pays. In state court, in general each side is responsible for their own attorney's fees. GENERALLY SPEAKING

John Sands just needs to realize that he made a mistake letting his 10 year old daughter and friend ride with someone that had been drinking and not making the kids ride with helmets and not using the seatbelts provided....the Rhino didn't cause the accident...the driver did
